Why Does the Global Spyware Industry Continue to Thrive? Trends, Explanations, and Responses

Abstract: 

Despite recent backlash to spyware and digital forensics technologies, especially related to the Pegasus program, the commercial market has continued to thrive. Demand has remained high, partially, due to just under half of world governments contracting with commercial spyware firms, with the vast majority of those being autocratic regimes. With a vested interest in controlling their populations, these nations have no interest in seeing the spyware and digital forensics market collapse. Even democratic nations have been inconsistent in their opposition to these technologies, as companies take advantage of less heavily regulated nations and loopholes in legal frameworks. And while Israel remains the world's largest exporter of these technologies, a new secondary tier of providers are providing open-source and commercial malware, making it easier for actors to launch attacks and remain anonymous. Even if a single spyware company is banned, the intended disincentive for other companies is overshadowed by consistent high demand.
