The Three Top Issues to Address for the Global Cybercrime Treaty

Abstract: 

This policy memo was drafted in response to a new Cybercrime Treaty currently being drafted by the UN Ad Hoc Committee on Cybercrime (as of 2023). Along with 10 other civil society organizations, the Center for Democracy and Technology published this letter, which emphasizes the importance of three main issues that they argue should be incorporated into the new treaty. The first issue emphasized in the report is that the new treaty should clearly and rigorously define its scope. The authors argue that the treaty should define the scope of cyber investigations and which types of cyber-crimes are included in the treaty. For example, the treaty should state whether it includes crimes that are facilitated by the use of technology (but do not depend directly on technology). The second issue that the letter highlights is data protection for international cooperation. The letter argues that the treaty should create an exemption for full cooperation in the case that data sharing between nations endangers data protection and privacy. Finally, the third key issue is that the treaty should include safeguards for human rights, such as discrimination based on race, religion, nationality, or ethnic origin.
