Analysis | The Perilous Path to a New Cybercrime Treaty.

Abstract: 

The UN recently completed a round of negotiations on a cybercrime treaty. “Our objective in that process is a focused criminal justice instrument which is aimed at improving the investigation and prosecution of cybercrime.” In 2001, 68 countries signed the Budapest Convention which expanded international cooperation on cybercrime and standardized laws. Russia, however, objected to its authorization of cross-border operations. In 2019, they advanced a new resolution with several other countries. This new resolution has significantly more offenses, including some regarding content - raising concerns about free speech protection. Several other offenses would create direct conflicts with human rights obligations. The US is watching closely to ensure that the new treaty does not cater to authoritarian government interests.
