Privacy Issues in Cyberspace: An Indian Perspective

Abstract:

This paper examines the intricate challenges of cyber privacy in the context of India and the Indian legal system. “This article has focused on the (i) Analysis of the novice modes of the tarnishing privacy in cyberspace in India and (ii) Legal control mechanism to combat commission of crimes.” The paper addresses how the growth of the internet has redefined traditional notion of privacy, highlighting how electronic footprints can be exploited by malicious actors. The author identifies several key threats to privacy is cyber privacy including cyber snooping and stalking, corporate espionage, identity theft, and Website defacement. The study critically analyzes the current legal framework, like Information Technology Act, 2000 and recent proposals like the Data Bill, and aseses their effectiveness in safegaurding privacy. It concludes with recommendations for enhacing cyber jurisprudence through increased awareness, stricter regulatory compliance, and the adoption of international security standards, thereby reinforcing the right to privacy in the digital world.
